In this Terms and Conditions of Use Agreement (“Agreement”, “Terms of Use, or “Terms”), “NV Bekaert SA”, “we”, “us”, or “our” refers to NV Bekaert SA and its affiliates, specifically including its Heat Resistant Textile business. NV Bekaert SA provides certain services and the use of our site fencing.bekaert.com (the “Site”) to you subject to the following terms and conditions.

BY ACCESSING THIS WEBSITE OR USING ANY OF ITS FEATURES, YOU AGREE TO THESE TERMS OF USE AND ARE DEEMED TO HAVE ACCEPTED THE TERMS AND CONDITIONS OF USE IN THEIR ENTIRETY. 1. General
Welcome to the Site which is owned and operated by NV Bekaert SA through its Heat Resistant Textile business.
NV Bekaert SA transforms steel wire and applies coating know-how to develop agricultural fencing and containment products. We improve both the bulk and surface properties of steel wire products to meet the needs of our customers. To do so, we group the wires into cords, ropes and strands, weave or knit them into fabric, or process them into an end product. Depending on the application, we apply coatings which reduce friction, improve corrosion, resistance, or enhance adhesion with other materials. By using the Site, you are licensed to use it only for the purpose of engaging with NV Bekaert SA under this Agreement.
2. Terms
This Agreement sets forth guidelines for the use and viewing of our Site. By browsing to the Site, you (as a “Visitor”) agree to these Terms of Use. A “Visitor” is defined as any individual browsing the Site. These Terms of Use constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”) and NV Bekaert SA, concerning your access to and use of the Site as well as any other media form, media channel, mobile website or mobile application related, linked, or otherwise connected thereto.
NV Bekaert SA reserves the right, at its sole discretion, to change, modify, add, or delete portions of these Terms of Use at any time without further notice. NV Bekaert SA will post any changes to these Terms of Use on the Site. All changes are effective immediately when we post them and apply to all access to and use of our Site thereafter. Your continued use of our Site following the posting of revised Terms and Conditions of Use means that you accept and agree to the changes. We encourage you to periodically review this page for the latest information on our Terms of Use, as they are binding on you. We will alert you about any changes by updating the “Last updated” date of these Terms, and you waive any right to receive specific notice of each such change. NV Bekaert SA may terminate your right to and deny you access to this Site if, in our sole discretion, you fail to comply with any term or provision of this Agreement, or for any other reason whatsoever.
Use of this Site is limited to persons eighteen (“18”) years of age and over. The policy of NV Bekaert SA, as the operator of this Site, is NOT to knowingly collect any personal information from persons under 13, including “individually identifiable information,” as defined by the Children’s Online Privacy Protection Act (“COPPA”). Moreover, the policy of NV Bekaert SA, as the operator of this Site, is NOT to knowingly collect any personal information from persons between the ages of 13 and 18 without parental consent. If you are under the age of 18, you should leave the Site without providing any information about yourself. Any access to or use of this Site by anyone under the age of majority requires consent to this Agreement by a parent or legal guardian. By accessing or using the Site, you represent and warrant to us that you are either a legal adult or, if under the age of majority, have obtained proper consent from a parent or legal guardian to your use of the Site and to be subject to the terms of this Agreement. NV Bekaert SA may collect certain Visitor information that is voluntarily provided by you or with your permission. For example, we may ask you for information, such as your phone number and e-mail address, when you connect with us via contact forms on the Site or when you complete orders. When you provide information to NV Bekaert SA in connection with your access to or use of the Site, you agree to provide only true, accurate, current, and complete information.

4. Product Orders
We try to be as accurate as possible with the information we present on our Site. We will make reasonable efforts to accurately display the attributes of the products we sell. We do not warrant that product descriptions or other content is accurate, complete, or error free. Prices and promotions are subject to change and may vary from those offered in physical retail locations. We cannot confirm the availability or price of an item until you place your order. Despite our best efforts, sometimes an item in our catalog may not be available, the offer may have been misstated, or an item may be mispriced. For any of these reasons, we may cancel your order or we may contact you for instructions on the order.
Our order confirmation to you does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell. At any time after receipt of your order, we may accept, decline, or place quantity or other limits on your order for any reason. We may impose these limits on a per-person, per-household, per-order, or any other basis. If we reject, limit, or otherwise modify your order, we will attempt to notify you using the email address you provide to us. If we cancel an order or part of an order that we have already charged you for, we will refund you the full amount of the canceled portion of the order. During the order process, you will have the opportunity to identify and correct input errors prior to making your order utilizing the steps in the checkout process.
Prices exclude VAT and delivery costs, which will be automatically added to the total amount due. Payments may be made by American Express, VISA, and Mastercard. The amount of the purchased products plus additional fees will not be withdrawn until they are shipped. The purchased products will be delivered to the delivery address you specify during the checkout process. We will make reasonable efforts to deliver your products on or before the date for delivery set out in the order confirmation, or, if no date is set out in the order confirmation, within 10 days following the date of the order confirmation; however, we do not guarantee delivery by this date. We will only deliver products to addresses within the United States and Canada. Once the purchased products have been delivered you are responsible for them. Products will pass to you upon delivery, provided full payment including any delivery charges, have been received. NV Bekaert SA shall not be held liable for any damages, whether incidental, consequential, or otherwise, for failure to fill orders, delay in delivery or any error in fulfilling orders.
You are entitled to cancel your order prior to shipping and request a refund or exchange. Contact us via the contact us form on our website. If you wish to return your product(s), you will need to follow the instructions in our website and book a courier collection, as needed. Please visit the contact form on our site and submit a claim to request a return. Once we have received your claim, you will receive an e-mail notification and your order status on the site will change to “claim received”. We may request additional information from you via e-mail. Once we have received your return and can confirm the products are in unused condition, we will refund you for the purchased products excluding delivery costs, by the method you used for payment. We will make these refunds due to you within 14 days from the day on which we receive the products back from you. You will be informed about your refund via e-mail.
5. Copyright, Trademark, and Site Mark Information
This Site and all digital content in any form on the Site, including all designs, text, graphics, pictures, video, audio, information, applications, and other files, and their selection and arrangement (each, “Digital Content”) are the exclusive property of NV Bekaert SA, its licensors, or other third parties and are protected by copyright, trademark, and other intellectual property laws. Visitors may not modify, transmit, publish, participate in the transfer or sale of, reproduce, create derivative works from, distribute, perform, display, or in any way exploit, any of the Digital Content, in whole or in part.
The NV Bekaert SA logos are proprietary trademarks and may not be used in connection with any product or material that is not provided by NV Bekaert SA, or in any manner that is likely to cause confusion among Visitors, or in any manner that disparages or discredits NV Bekaert SA.
All other trademarks displayed on the Site are the trademarks of their respective owners and may only be used with the permission of the owner. 6. Notification of Claimed Copyright Infringement
If you believe that your work has been copied and is accessible on our Site in a way that constitutes copyright infringement, you may notify us by providing our copyright agent the following information:

7. Accessing the Site and Account Security
We reserve the right to withdraw or amend our Site, and any service or material we provide on our Site, in our sole discretion without notice. 10. Indemnification
You agree to defend, indemnify, and hold harmless NV Bekaert SA and its affiliates and their respective directors, members, officers, employees, and agents from and against any and all claims, actions, demands, damages, costs, liabilities, losses and expenses (including reasonable attorneys' fees) arising out of your use of the Site, including but not limited to, the violation of this Agreement, or infringement of any intellectual property rights.
11. Modifications and Interruption to Service
NV Bekaert SAreserves the right to modify or discontinue any services on the Site with or without notice. NV Bekaert SA shall not be liable to a Visitor or any third party should NV Bekaert SA exercise its right to modify or discontinue any service on the Site. Each Visitor acknowledges and accepts that NV Bekaert SA does not guarantee continuous, uninterrupted or secure access to the Site and operation of the Site may be interfered with or adversely affected by numerous factors or circumstances outside of our operation or control.

13.Prohibited Activities
The following actions are not allowed on this Site:

By breaching any of the provisions above, you would commit a criminal offense. 14. Governing Jurisdiction
This Agreement will be governed by and construed in accordance with the laws of Belgium, without regard to any principals of conflicts of law. Any and all services and rights of use hereunder are considered performed in Belgium and you agree that any action at law or in equity that arises out of or relates to BEKAERT or these Terms of Use will be filed only in the courts of Brussels, Belgium, and you hereby consent and submit to the personal jurisdiction of such courts for the purposes of litigating any such action
15. Compliance with Laws and International Use
You assume all knowledge of applicable laws and are responsible for compliance with any such laws. You may not use the Site in any way that violates applicable state, federal, or international laws, regulations, or other government requirements. Such laws may include but are not limited to the General Data Protection Regulation (“GDPR”), and the California Consumer Privacy Act (“CCPA”), and the Personal Information Protection and Electronic Documents Act (“PIPEDA”). NV Bekaert SA reserves the right to use any information available by virtue of your use of the Site (including, for example, reverse IP address inquiry) in order to comply with any law, to enforce our Terms of Use or Privacy Policy, or to protect the rights, property or safety of all Visitors. We reserve the right without obligation to review the content of the Site, and other information posted to the Site to determine compliance with our Agreement and operating rules established by us or our affiliates, and to satisfy any law, regulation or authorized government request.
The information provided on the Site is not intended for distribution to or use by any person or entity in any jurisdiction or country where such distribution or use would be contrary to law or regulation or which would subject us to any registration requirement within such jurisdiction or country. General Information We Collect and How We Use It
We collect Visitor Information when you use our Site. Sometimes you may submit it to us yourself, other times it may be collected automatically. Our handling of your Visitor Information is generally limited to processing product orders, newsletter registration, addressing warranty-related issues, shipping products to consumers, and handling and resolving general inquiries. - Commercial Information – We collect records of products or services purchased, obtained, or considered or other purchasing or consuming histories or tendencies.
- Non-Identifying Information – We collect information that is about you but does not individually identify you, such as anonymized and aggregate information about pages visited, length of time spent on our Site and its webpages, etc.

Web Beacons
Our web pages may contain electronic images known as web beacons (invisible images often referred to as pixel tags or clear GIFs) on the Site in order to recognize users, assess traffic patterns, identify preferred content, and measure Site engagement. We may also include web beacons in our e-mail messages, including newsletters, in order to count how many e-mail messages have been opened, for example.
Some of these web beacons may also be placed by third-party service providers to help determine the effectiveness of advertising campaigns. Use of Your Information
We collect, process and disclose your Visitor Information only for specific and limited purposes. For example, to respond to inquiries received from the use of any contact forms on the Site, to assess and handle any complaints, to develop and improve our services, communication methods and the functionality of our Site.
Our primary goal in collecting, using, and sharing Visitor Information is to enhance your experience on the Site, support the Site, and improve its features, performance, and other elements. We follow generally accepted industry standards to protect the Visitor Information submitted to us, both during transmission and once we receive it. How Long We Keep Your Information

CHILDREN’S ONLINE PRIVACY PROTECTION ACT (“COPPA”) NOTIFICATION
Our Site is not designed for persons under the age of eighteen (“18”). We are not responsible for any access or use of the Site by children or minors under the age of 18. We endeavor to substantively respond to verifiable consumer request within forty-five (45) days of its receipt. If we require more time (up to another 45 days), we will inform you of the reason and extension period in writing.
If you have an account with us, we will deliver our written response to that account. If you do not have an account with us, we will deliver our written response by mail or electronically, at your option.
The response we provide will explain the reasons we cannot comply with a request, if applicable. For data portability requests, we will select a format to provide your personal information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance.
We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.
Only you, or someone legally authorized to act on your behalf, may make a request related to your personal information. You may also make a request on behalf of your child. You may only submit a request to know twice within a 12-month period. Your request must:
- Provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative; and
- Describe your request with sufficient detail that allows us to properly understand, evaluate and respond to it.
We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you. We will only use personal information provided in the request to verify the requestor’s identity or authority to make it.
Moreover, California Civil Code Section 1798.83, also known as the “Shine The Light” law, permits our users who are California residents to request and obtain from us, once a year and free of charge, information about categories of personal information (if any) we disclosed to third parties for direct marketing purposes and the names and addresses of all third parties with which we shared personal information.
